By creating an account, uploading content, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. 2. User Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Service Description & Usage
Our Service uses artificial intelligence to transform your product photos into promotional social media posts. You agree not to use the Service for any unlawful purpose or to violate any laws in your jurisdiction. Misuse of the service may result in account termination.
4. Intellectual Property
You retain all ownership rights to the original photos you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify it solely for the purpose of providing the Service to you. You own the final promotional posts generated by the Service. However, we retain ownership of the underlying AI models, algorithms, and technology.
5. Payment and Subscriptions
Certain features of the Service may be provided for a fee. You agree to pay all applicable fees for the subscription plan you select. All fees are non-refundable, except as required by law. Subscriptions will automatically renew unless you cancel your subscription through your account settings before the end of the current billing period.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the settings page.
7. Disclaimers & Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the results obtained from the use of the Service will be accurate, reliable, or meet your requirements. In no event shall Festiv Ai, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in Delaware.
